This is the English version of the Dutch terms of use. These Terms are what you agree to when you use the App, so this matters here: if the English and Dutch texts differ in any way, at any point, the Dutch version prevails.
1. General
These terms of use ("Terms") apply to the use of the PMDD Tracker app ("the App"), developed and operated by FemTech Solutions B.V. (product: PMDD Tracker) ("we", "us", "our").
By downloading, installing or using the App, you agree to these Terms. If you do not agree, we ask you not to use the App.
2. Description of the service
The App is a personal symptom tracker for Premenstrual Dysphoric Disorder (PMDD) and premenstrual symptoms. The App offers:
- Daily symptom entries based on the DRSP form
- Optional custom symptoms (up to 10 symptoms you define yourself, scale 1-6)
- Cycle tracking and phase recognition
- Visual overviews and trends over time
- A personal signalling plan
- Crisis contact functionality
- PDF export for healthcare providers
- Optional cloud synchronisation
- Optional anonymous data donation for scientific PMDD research
3. Medical disclaimer
THE APP IS NOT A MEDICAL DEVICE.
- The App is intended as a recording and insight tool for recognising cyclic patterns in self-reported data. The App does not provide diagnoses and does not replace a professional healthcare provider.
- The cyclic overview (based on the C-PASS method) is an aid for recognising patterns in self-reported data and shows no classification labels to the user
- The DRSP form is a recognised recording instrument, not a diagnostic test
- The App does not replace professional advice from a healthcare provider
- Always consult a doctor or specialist for professional advice about PMDD or other conditions
- In the event of a crisis: call your local emergency number (112 across Europe), or find a helpline for your own country at findahelpline.com. In the Netherlands: 113 (Zelfmoordpreventie)

4. Account and registration
4.1 Registration
To use the App you can create an account with:
- Your email address and password, or
- Apple Sign In (via your Apple ID), or
- Google Sign-In (via your Google account)
If you register via Apple or Google, your email address and name are taken over automatically from that provider.
You are responsible for:
- Providing correct information
- Keeping your login details confidential
- All activity that takes place under your account
- Securing your Apple or Google account if you use it to sign in
4.2 Use without an account
The App can also be used without an account, with local storage only. In that case cloud synchronisation is not available.
5. Use of the App
5.1 Permitted use
You may use the App for personal, non-commercial purposes in accordance with these Terms.
5.2 Prohibited use
You may not:
- Use the App for unlawful purposes
- Reverse engineer, decompile or disassemble the App
- Copy, modify or distribute the App
- Circumvent the security measures of the App
- Use the App to cause harm to others
6. Intellectual property
6.1 Ownership
All intellectual property rights relating to the App, including but not limited to the software, design, texts, logos and graphic material, belong to FemTech Solutions B.V.
6.2 Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal purposes.
6.3 Your data
The symptom data, signalling plans and other personal data that you enter in the App remain your property. You can export or delete them at any time.
7. Availability and maintenance
7.1 Availability
We aim to keep the App continuously available, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to planned maintenance, technical failures or force majeure.
7.2 Offline functionality
The App is designed to work fully offline. Data stored locally remains available regardless of the status of the servers.
7.3 Updates
We may update the App from time to time. We recommend always using the latest version.
8. Liability
8.1 Limitation
The App is provided "as is" and "as available". To the extent permitted by law:
- We are not liable for indirect, incidental or consequential damage
- We are not liable for medical decisions taken on the basis of information in the App
- We do not guarantee that the App works without errors or interruptions
8.2 Maximum liability
Our total liability is limited to the amount you have paid, if any, for the use of the App in the 12 months preceding the event giving rise to the liability.
9. Privacy
Your privacy is important to us. The collection and processing of personal data is described in our Privacy Policy. By using the App, you agree to our Privacy Policy.
10. Research data donation
The App gives you the optional possibility of contributing anonymous symptom data to scientific research into PMDD. The following applies:
- Taking part is entirely voluntary and requires your explicit consent
- The data is fully anonymised on your device before it is sent
- Once anonymised, the data can no longer be traced back to you as a person
- You can withdraw your consent at any time via Settings → Contribute to research
- After withdrawal, no new data is shared
- Anonymous data already donated cannot be deleted, because no link to your account remains

11. Termination
11.1 By you
You can stop using the App at any time and delete your account via Settings → Delete account.
11.2 By us
We reserve the right to suspend or terminate your access to the App in the event of a breach of these Terms, misuse of the service, or a legal obligation.
11.3 Consequences of termination
On termination, your data will be deleted in accordance with our Privacy Policy. Local data on your device is not deleted automatically; you can delete the App yourself.
12. Changes to the Terms
We may change these Terms from time to time. In the event of substantial changes, we will inform you through the App. Continued use of the App after a change means you accept the amended Terms.
13. Applicable law and disputes
These Terms are governed by Dutch law. Disputes will preferably be resolved by mutual agreement. If that is not possible, disputes will be submitted to the competent court in the Netherlands.
